Justice Department says it will re-try Sen. Bob Menendez

According to a filling introduced by the Department of Justice this Friday, Senator Robert Menendez will be brought to justice again on charges of corruption, a battle he has waged for years.

Mr. Menendez, a Democrat, and his co-defendant, Salomon Melgen, were indicted for bribery and corruption by two separate grand juries, federal prosecutors said in a court filing Friday.

"An early retrial date is in the best interests of the public, . The only thing I can possibly think of is that you can't believe that a Latino kid who grew up poor and ultimately comes from this county that has a history - somehow, how does he get to be a US senator without doing things that are wrong?", the Senator said.

The Justice Department was facing a deadline to either retry the case or drop the charges later in January.

Melgen, who has been convicted on other separate counts, has yet to be sentenced, and some political observers believe the federal authorities may seek to offer him a plea deal on the earlier case to testify against Menendez in the upcoming trial.

Mr. Menendez's office did not immediately respond to request for comment.

"We regret that the DOJ, after spending millions and millions of taxpayer dollars, and failing to prove a single allegation in a court of law, has chose to double down on an unjust prosecution", the statement read. "Evidently, they did not hear the overwhelming voices of the New Jerseyans who served on the jury this fall".

After the first jury deadlocked in the case, one of the jurors told The Washington Post that the government didn't have enough evidence to support its charges.

They accused the senator of pushing officials to help resolve an $8.9 million Medicare billing dispute in Melgen's favor, while the defense team claimed at trial that Menendez was focused on the fact that the billing policies at issue were conflicting and the drug companies were enjoying a windfall.

The first trial began the week of Labor Day and lasted until mid-November.

Defence lawyers argued during the trial that Melgen's gifts, which included a stay at a luxury Paris hotel and free trips for Menendez on Melgen's private jet to his villa in the Dominican Republic, were an expression of the pair's longtime friendship and weren't bribes.
