Can California preserve net neutrality? Lawmakers pledge to try

While Democrats have reached a crucial threshold for bringing the bill to vote on the Senate floor, it's unlikely to pass since Republicans control both the House of Representatives and the Senate.

The Internet Association, comprised of Facebook, Google, Amazon, Twitter, Netflix and other large tech firms, said on january 5 that it plans to join the looming legal fight against the Federal Communications Commission over its repeal of so-called net neutrality rules, according to the New York Times. Those rules, which capped a decade-long process by the agency of trying to guarantee net neutrality, barred broadband service providers from blocking, slowing, or providing preferred access to particular online sites or services.

A few weeks the FCC announced that they will move the internet from a Title II to a Title I service. But it appears that in this case, at least 30 Democrats are willing to use the trick to protect net neutrality.

Even so, Markey called the bill a "big step toward restoring a free and open internet", and remains hopeful that net neutrality will be restored.

Last month, the FCC voted along party lines to eliminate its 2015 net neutrality rules.

"In today's digital world, the internet is critical to free expression, free speech, and democracy", de León said in a statement.

Other states are also considering legislation to re-enact net neutrality rules on a local basis while activists groups and several state attorneys general have sued the FCC to stop the repeal of the rule. The fact that no Republicans have signed on to the resolution likely means it would be defeated in a floor vote.

The repeal of net neutrality could destroy the existing free internet in the U.S.as we know it. The draft includes the text and final wording of the new rules that will come into force under the FCC and its justifications of it. A University of Maryland poll last month found they were supported by 83% of Americans, including 75% of Republicans.

Sen. Scott Wiener, D-San Francisco, promoted dueling legislation - now in the form of spot bill SB 822 - stating the Legislature's intent to "effectuate net neutrality in California utilizing the state's regulatory powers". "IA intends to act as an intervenor in judicial action against this order and, along with our member companies, will continue our push to restore strong, enforceable net neutrality protections through a legislative solution".
