In its modern form, it is sometimes blamed for the deep partisan polarization of Congress and other legislative bodies, because modern computer science and detailed census data makes it so much easier for those in charge of drawing new maps to place individual voters into districts to make them decidedly Republican or Democratic so as to achieve unequal electoral power.

Schimel is a Republican who is defending the maps. "As I have said before, our redistricting process was entirely lawful and constitutional, and the district court should be reversed".

Democratic voters sued and claimed that the legislature's action violated their First Amendment associational rights and 14th Amendment equal protection rights.

Those maps, drawn mainly in secret by Republican lawmakers, had achieved one of the clearest cases in modern political history of achieving a lasting advantage for Republican candidates, even though the state's voters are about evenly divided in their affiliation with the two major parties.

The outcome of the Wisconsin case will likely depend on whether Kennedy still believes this.

The legislature canceled Cooper's call for a special legislative session for redistricting the following day.

On Monday, the Supreme Court agreed to hear an appeal this fall of a lower court ruling that struck down Wisconsin's Republican-drawn state Assembly map as an unconstitutional partisan gerrymander. The Court's order provides that "further consideration of the question of jurisdiction is postponed to the hearing of the case on the merits", suggesting that numerous Court's members think that federal courts do not have the power to hear gerrymandering cases.

Critics have argued the current legislative maps unfairly stack the deck for Republicans district by district, pointing to the 2016 presidential election results as an example.

Schimel had asked the Supreme Court to delay the drawing of new boundaries until after the court rules on the merits of the case.

Republicans might stuff Democratic voters into Democratic districts, leaving other districts with Republican majorities that are essentially just large enough to elect GOP candidates. And in other areas, they said, Republicans packed Democrats into a few districts to limit their ability to control more seats.

Even justices who favor giving lawmakers discretion to draw district lines hold their noses when it comes to how they do it.
