Judge allows Iowa abortion waiting period to go into effect

"This ruling means that dozens of women today are able to access the care they need", Suzanna de Baca, Planned Parenthood of the Heartland's CEO, said in a statement. Branstad announced Friday that he'd sign the bill Tuesday despite arguments from opponents that expanding fireworks sales would lead to more injuries and property damage.

The injunction enabled 44 women who were scheduled for abortions on Friday to keep their appointments.

Senate File 471 additionally bans all abortions starting at 20 weeks with no exceptions for rape, incest, or fatal fetal conditions.

The lawsuit - filed by the ACLU of Iowa and the Planned Parenthood Federation of America on behalf of Planned Parenthood of the Heartland - contends the measure contains provisions that are unconstitutional violations of women's equal protection and rights to legal abortion.

The voter identification bill signed by Branstad will require voters to show ID at the polls, a measure that Secretary of State Paul Pate said will be in effect for the 2018 Iowa gubernatorial election thanks to a "soft rollout" of the law.

"The act thus imposes a medically unnecessary mandatory delay", they argued, adding that physicians who violate the mandatory delay and additional trip requirements are subject to discipline.

The Iowa Supreme Court ordered the state to file a response to Planned Parenthood's motion for an injunction by noon Monday.

Iowa Solicitor General Jeffrey Thompson argued there is not a constitutional right to an abortion on demand. The state says these burdens are created by society and not the new law.

"The court will then consider whether the injunction should remain in force pending this court's resolution of appellants' application for interlocutory appeal", the one-page order states.

Fowler declined to comment further, but on Thursday the ACLU said Iowa lawmakers and Branstad were putting politics ahead of women's health. "The only thing gained by this law is that a group of politicians have made voting harder for Iowa voters, especially low-income people, people of color, transgender Iowans, senior citizens, and those Iowans with disabilities".
