What the death of broadband privacy rules means

"The vote in Congress to repeal the broadband privacy rules, allowing internet service providers to spy on their customers and sell their data without consent, is a bad setback for the American public", said Susan Grant of the Consumer Federation of America.

The repealed law had set out to give more control to consumers over their privacy online, ensuring that Internet Service Providers (ISPs) would have to notify their customers before collecting and sharing your online insight about your online behavior.

On the same day, the White House said that the Trump administration was in favor of repealing the privacy rules.

The vote is part of an extensive effort that Republicans have undertaken to void an array of regulations issued during the final months of Democratic President Barack Obama's tenure. Minority Leader Nancy Pelosi, D-Calif., said Republicans put profits over the privacy concerns of Americans. In crafting the broadband privacy rules, the FCC appropriately said that for our most sensitive information, consent should be on an opt-in basis. Jeff Flake (R-AZ), who introduced the repeal bill in the Senate, argued the overturned FCC rules could "limit consumer choice, stifle innovation, and jeopardize data security by destabilizing the Internet ecosystem".

The FCC's sister agency, the Federal Trade Commission, can bring privacy complaints against web-based companies that aren't ISPs, but the FTC can't create privacy regulations. "In my view, the best way to achieve that result would be to return jurisdiction over broadband providers' privacy practices to the FTC, with its decades of experience and expertise in this area".

Last Tuesday, the House of Representatives agreed with the idea to revoke Obama's Internet Privacy Protection in his time of service. "The public backlash following the party-line vote in the Senate clearly had an impact, as 15 Republicans broke ranks to vote against the measure", said Evan Greer, campaign director for Net freedom group Fight for the Future.

Trump has not talked as president about net neutrality but in 2014 tweeted he opposed net neutrality. In doing so, the door will be open for ISPs to do anything they like with the data of U.S. citizens. They should be able to do so without fear that their Internet service providers are logging their activities and selling the data.

"We simply want them to get our approval before they can sell this information to the highest bidder".

Opponents to the laws suggest that broadband providers would face an undue burden in comparison with other large internet firms such as Facebook and Google, who are now free to collect data without permission. The rules also required ISPs to protect browsing data from hackers and alert customers of breaches.
