Arrested 'dreamer' Daniela Vargas to be released, lawyers say

Attorneys at Elmore & Peterson Law Firm, which is representing Vargas, said in a statement that they "expect Daniela to return to her friends and community in MS shortly to resume her daily life and pursue her dreams".

Federal agents detained Vargas on March 1 just minutes after she criticized US deportation policies at a news conference in Jackson.

Vargas, originally from Argentina who came to the U.S.as a child, also was in the house when ICE came for her father and brother on February 15, but agents declined to arrest Vargas then.

Vargas is still not safe from deportation, but will be able to live outside of immigrant detention as she awaits a final decision on her case. "We maintain our commitment to the rights of all persons in the USA, regardless of immigration status".

The terms of the Order of Supervision are unknown at this time, lawyers said.

ICE spokesman Thomas Byrd later released a statement saying Vargas had been detained as part of a "targeted immigration enforcement action"-an explanation that did nothing to undercut the impression that Vargas was being punished for sticking her neck out to voice her beliefs". One of her friends, Jordan Sanders, said federal agents in unmarked cars pulled them over five minutes after they left. Vargas spoke at a rally in Jackson, Mississippi, last week about her dream of becoming a math teacher. She was picked up at the detention center by the friend who had been driving the vehicle she was in as a passenger when ICE arrested her.

Vargas, who was born in Argentina, has been in the United States since age 7, and was living here legally as a Dreamer under Obama's Deferred Action for Childhood Arrivals policy until her status lapsed in November.

The Southern Poverty Law Center had accused ICE agents of targeting Vargas days later because of her comments about the agency at that day's news conference and other public events where she had spoken. The administration has declined to answer whether it plans to terminate the program, which Mr. Trump said he would do immediately upon taking office.
