Jeff Sessions isn't the attorney general we need

In a completely unsurprising development, the question of whether or not a DOJ official must resist orders from the President if those orders run counter to the official's oath to support and defend the Constitution was brought up at Sally Yates's confirmation hearings.

Sessions is still likely to be confirmed for the role, but Tuesday's procedural move by Democrats is a thorn in the side of Trump and Senate Republicans. So, she didn't stand to lose much by speaking out against Trump's banning of refugees from seven Muslim-majorities countries (while he ignored Saudi Arabia because he does a lot of business there).

The Attorney General holds the key position of being the chief law enforcement officer as well as chief lawyer of the United States government.

Activists and constituents put major pressure on Democratic senators to delay Sessions' hearing until the travel ban was lifted, and the senators didn't miss the symbolic value of Yates' gesture. A lot of people have defended the [former Attorney General Loretta] Lynch nomination, for example, by saying, 'Well, [former President Barack Obama] appoints somebody who's going to execute his views. On Monday, Yates believed she was following that obligation.

The American Civil Liberties Union called for Democrats to protest Trump's nominations until the executive order is rolled back.

Mr Trump replaced her with Dana Boente, a federal prosecutor for the Eastern District of Virginia. If he clears committee, the Senate could confirm him and allow him to take over the Justice Department by week's end.
